Toto Travel (Drifter j.d.o.o.), hereinafter referred to as the “Organizer”, provides boat tours, transfers, boat hire and additional services within the legal framework of a boat rental company in accordance with the laws of the Republic of Croatia and the European Union.

GENERAL CONDITIONS OF TRAVEL

These Terms and Conditions apply to all bookings made via the Toto Travel website at www.toto.hr, bookings made at the Toto Travel office (Trumbićeva obala 2, Split), by contacting the office at info@toto.hr, by telephone, or by intermediation of partners.

By confirming a reservation, the customer confirms that they have read, understood, and accepted these Terms and Conditions.

DEFINITIONS

Organizer – Toto Travel (Drifter j.d.o.o.).
Customer – any person making a reservation for themselves or for a group.
Service – any tour, transfer, rental, or boat hire service offered by the Organizer.
Partner – any legal entity or intermediary booking services on behalf of their clients.

BOOKING AND PAYMENT OPTIONS

A reservation is considered confirmed when the Organizer receives payment of (at least) a deposit in the amount of 50% of the total reservation price. No reservation will be confirmed without payment in advance.
After receiving payment, the Organizer will send a booking confirmation.

In case a deposit is paid in order to confirm the reservation, the remaining amount must be paid no later than 14 (fourteen) days prior to departure.

The Organizer offers three means of payment:
– Cash or card payment at the Toto Travel Office
– Card payment in case of online booking at www.toto.hr
– Wire transfer (bank account info will be sent upon request)
– Payment via Teya payment link

PAYMENT PROCESSING FEE (TEYA PAYMENT LINK)
Payments made via a Teya payment link are subject to an additional processing fee of 3% of the total reservation price. This fee covers administrative and payment processing costs.

By choosing to pay via a Teya payment link, the customer expressly agrees to the additional 3% processing fee.

The Organizer reserves the right to cancel any reservation if payment is not received within the agreed deadlines.

PRICES AND SERVICE DETAILS

All prices are stated in EUR unless otherwise specified.

The Organizer reserves the right to adjust prices in case of significant changes in operating costs (fuel price increases, port authority fees, taxes, or other costs beyond reasonable control). Any price change will be communicated to the customer prior to departure.

INCLUSIONS AND ADDITIONAL COSTS

Group (shared) boat tours organized by Toto Travel include the boat transportation, crew, fuel, and safety gear.

Private boat tours and skippered boat hire include private boat transportation, crew, fuel, and safety gear, unless otherwise specified in the offer.

Luxury private boat tours include private boat transportation, crew, fuel, bottled water, towels, welcome drink and safety gear.

Bareboat rental includes the daily rental of a boat and necessary safety equipment. Fuel is not included and is an additional charge.

Entrance fees, food, drinks, and other services not explicitly included are not included in the price and are an additional cost.

SECURITY DEPOSIT (BAREBOAT RENTAL)

For bareboat rental, the Organizer requires a refundable security deposit which amounts from 500 EUR up to 2000 EUR, depending on the vessel in question.

The deposit must be paid before departure and will be returned after the vessel inspection, provided no damage has been caused.

CHANGES TO RESERVATIONS

Any changes by the customer must be made by telephone, by e-mail at info@toto.hr, or directly in the agency’s office.

Changes that include a change in the number of participants or the date of service must be made no later than two days prior to departure.

The Organizer reserves the right to adjust the price according to the changes in the reservation.

CANCELLATION POLICY

Any cancellation from the customer or intermediary partner must be made in written form by e-mail at info@toto.hr.

GROUP (SHARED) TOURS

For a reservation canceled 24 hours or more prior to departure, the Organizer will issue a full refund.

For a reservation cancelled less than 24 hours prior to departure, the total price of the reservation will be charged.

In case of a no-show, the total price of the reservation will be charged.

PRIVATE TOURS, SKIPPERED BOAT HIRE AND TRANSFERS

A full refund is approved for reservations cancelled more than 7 days before departure.

For a reservation cancelled less than 7 days prior to departure, the total price of the reservation will be charged.

BAREBOAT RENTAL

A full refund is approved for bareboat reservations cancelled more than 7 days before departure.

For a reservation cancelled less than 7 days prior to departure, the total price of the reservation will be charged.

In case of cancellation, any bank transfer fees or transaction costs may be deducted from the refund.

CANCELLATION BY THE ORGANIZER

The Organizer reserves the right to cancel or appropriately alter the service in case of inclement weather, force majeure events, safety concerns, technical issues, or restrictions imposed by relevant authorities.

The customer will be informed accordingly and will be offered to reschedule or receive a full refund.

The Organizer reserves the right to cancel the tour in case of an insufficient number of participants. In that case, the customer will be informed and a full refund will be issued.

Refunds are processed within 7–14 business days depending on the payment method and banking procedures.

FORCE MAJEURE

The Organizer is not responsible for service cancellation, delay, alteration or interruption due to force majeure events, including but not limited to: extreme weather conditions, natural disasters, government restrictions, pandemics, port authority decisions, strikes, war, terrorism, or technical vessel failure beyond reasonable control.

In such cases, the Organizer will offer rescheduling or refund of payments received.

LATE ARRIVAL AND NO-SHOW

Customers are required to arrive at least 15 minutes prior to the scheduled departure time.

In case of late arrival, the Organizer reserves the right to start the service without the customer. In such case, the reservation will be considered as a no-show and no refund will be issued.

SAFETY AND CUSTOMER CONDUCT

All customers must follow safety instructions given by the skipper and crew.

The skipper’s decision regarding safety is final.

The Organizer reserves the right to refuse service, refuse boarding, or terminate participation if the customer is intoxicated, behaves aggressively, refuses to follow instructions, or endangers the safety of passengers or crew. In such case, no refund will be issued.

EQUIPMENT

All vessels used for organizing tours or rental purposes are equipped with all required safety equipment (life jackets, first aid equipment, etc.) in accordance with Croatian maritime regulations.

HEALTH

Organizer does not recommend speedboat tours or rental to customers with back problems or impaired mobility, customers using medication, and pregnant customers. Mentioned customers participate at their own responsibility.
The Organizer shall not be responsible for any injury, illness, death or loss resulting from:
customer’s acts and/or omissions
acts and/or omissions of third parties not connected with the service
force majeure events

CUSTOMER’S RESPONSIBILITY

The Organizer is not responsible for any loss of personal belongings, documents, money, or valuables.

Customers are responsible for their own behavior and compliance with Croatian laws and regulations.

The Organizer is not liable for delays or service disruptions caused by traffic, port congestion, or circumstances beyond reasonable control.

LIABILITY LIMITATION

The Organizer’s liability is limited to the amount paid for the service, except in cases of intentional misconduct or gross negligence.

AGE REQUIREMENTS

Customers must be aged 18 years or older to book a service.

Minors may participate only when accompanied by an adult or with written parental consent.

PARTNERS AND INTERMEDIARIES

If a service is booked through a partner or intermediary, the partner is responsible for ensuring that the customer is informed about these Terms and Conditions.

The Organizer is not responsible for incorrect information provided by partners.

PERSONAL INFORMATION AND GDPR

Toto Travel requires customer personal information (name, surname, contact number) for reservation purposes.

For bareboat rental, the customer must provide a valid boating license.

All personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 and applicable Croatian laws.

Personal data will not be sold, traded, or rented to third parties except when required by law.

PHOTO AND MEDIA USE

The Organizer may take photographs or video recordings during tours for promotional purposes.

Customers who do not wish to appear must inform the Organizer in advance.

COMPLAINTS

In the unlikely event that the customer has reason to complain, they must immediately inform the crew and the office.

If the customer remains dissatisfied, a written complaint must be submitted within 14 days of the end of the service, including booking reference and full details.

The Organizer will respond to complaints in accordance with applicable Croatian consumer protection regulations.

PRIVACY

Toto Travel is committed to protecting the customer’s and partner’s personal information.

GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the Republic of Croatia.

Any disputes arising from these Terms shall fall under the exclusive jurisdiction of the competent court in Split, Croatia.
